The government is demanding a judge deny Josh Duggar‘s request to suppress photographs of his hands taken by law enforcement that show a scar that matches those in images seized from his digital device as part of his child porn trial.

Duggar â€" best known for being a part of his family’s hit reality show, 19 Kids and Counting â€" is charged with downloading and possessing pornographic images of children under 12 years old, which he denies. 

On April 29, 2021 law enforcement took three high angle photographs of Duggar’s open hands over his feet while he was in custody, the Sun reported. 

Duggar’s legal team filed a motion to suppress those photographs, claiming it was ‘egregious’ that Duggar’s body parts were ‘manipulated and he was required to pose for the photographs.’

His legal team added the photographs were an ‘intrusion on (his) personal rights’ and ask they be removed from evidence. 

Duggar’s attorneys are arguing that law enforcement needed to obtain a warrant in order to photograph Duggar’s body parts and to authorize he pose in a particular manner for the photos, but the government is fighting back and demanding the judge in the case deny the request.

They claim in court documents that Duggar ‘expressly consented to having the photographs taken,’ and that was not ordered to remove any clothing for the photographs. 

The documents continue to allege that the photographing of his hands ‘did not constitute an unreasonable or warrantless search of the defendant’ and that ‘his hands were in plain view and clearly visible.’ 

The court docs say the photographs document a scar on Duggar’s hand that is ‘plainly visible’ and that ‘law enforcement observed the same scar in images recovered from the defendant’s electronic devices seized pursuant to a search warrant in this case.’

Last week new court documents revealed Duggar was placed on the Arkansas sex offender registry for molesting his sisters years before his arrest on child pornography charges this April.

The papers, filed August 30, claim ‘Joshua Duggar was placed on the sex offender registry and a legal proceeding was undertaken to remove Joshua Duggar from the sex offender registry.’

The claims were made by the city of Springdale and other defendants â€" referred to as the Springdale Defendants â€" in response to a lawsuit filed against them in 2017 by Duggar’s four sisters.

Duggar was accused of sexually assaulting five young girls as a teen back in 2015.

The allegations were first reported by In Touch magazine which, through a Freedom of Information request, unearthed a 2006 police report detailing Duggar’s alleged sexual abuse of the underage girls.

Four of the five girls were Duggar’s sisters, according to the police report.

Two of Duggar’s sisters â€" Jill Dillard and Jessa Seewald â€" later spoke out to reveal they were victims but that they had forgiven their brother.

Jill, Jessa, and their two sisters Jinger Vuolo and Joy Duggar filed a lawsuit in an Arkansas federal court in 2017 against the City of Springdale, claiming the release of the information to In Touch breached their privacy and caused ‘extreme mental anguish and emotional distress.’

In the new filings, the defendants argue the allegations that Duggar molested his sisters was already within public knowledge because he had already been placed on the sex offender registry over the alleged abuse before the police report came to light.  

Duggar was busted in 2019 after Detective Amber Kalmer of the Little Rock Police Department accessed his files while working on an undercover online investigation to unmask perverts using it to trade images, according to court documents obtained by DailyMail.com.

Authorities discovered that Duggar kept his trove of child pornography on his work PC hidden behind a screenshot of his family, 

Cops seized the HP laptop from Duggar’s office when they raided his Arkansas car dealership in 2019 to search for evidence of illegal downloads.

The computer’s home screen featured a wholesome family portrait of 33-year-old Duggar, his pregnant wife Anna and their six children, federal prosecutors reveal in a new filing.

But when experts delved into the device’s hard drive they soon uncovered sickening images of prepubescent engaged in sex acts, it’s alleged. 

She was able to locate two files: a zip folder containing 65 image files of naked girls aged between seven and nine, and a two minute video of a similarly-aged girl being raped by an adult man. 

After pleading not guilty to child pornography charges Duggar has been confined to the home of family friends who agreed to be his custodian during his release. He is prohibited from using any Internet-accessible devices as he awaits trial.

Duggar’s family rose to fame on reality show, 19 Kids and Counting which ran on TLC from 2008 to 2015.

The reality show was canceled in 2015 following the allegations that Duggar had molested his sisters and a babysitter. Duggar’s parents said he confessed to the fondling and apologized.

Duggar previously apologized for a pornography addiction and cheating on his wife, Anna, who is pregnant with their seventh child.

Anna Duggar has supported her husband through his legal battle â€" and Josh is allowed to see their children when she is present while he awaits trial.

His trial has been set for November 30, with a pretrial conference on November 18. If convicted, he faces up to 20 years of imprisonment and fines up to $250,000 on each count.
